Md. Code Regs. 14.17.12.02 Maryland's cannabis marketing regulations, found primarily in the Code of Maryland Regulations (COMAR) 14.17.14.06 and the Alcoholic Beverages and Cannabis Article, Title 36, Subtitle 9, impose strict rules to prevent targeting minors and making unsubstantiated claims. All cannabis advertising is overseen by the Maryland Cannabis Administration (MCA) and the Alcohol, Tobacco, and Cannabis Commission (ATCC). General Restrictions Targeting Minors: Advertisements may not target or be attractive to individuals under the age of 21 (or 18 for medical patients). This includes prohibiting the use of cartoon characters, mascots, or any imagery commonly used to market products to minors. Depicting Use: Advertisements cannot display the actual use of cannabis, including consumption, smoking, or vaping. Promoting Intoxication: Marketing materials must not encourage or promote cannabis for use as an intoxicant. False or Misleading Claims: All statements must be accurate, truthful, and not misleading. Unsubstantiated health or therapeutic claims are strictly prohibited. Obscenity: Advertisements cannot be obscene. Location and Placement Advertisements on building exteriors must be on the licensed premises, and medical cannabis advertisements cannot be within 500 feet of places like schools or parks. For various media platforms, including print and digital, at least 85% of the audience must be expected to be 21 or older. Direct mail is allowed only for individuals 21 or older in plain, sealed envelopes. Digital Media Requirements Websites require an age-gate for users 21 and older, with an alternative for medical patients under 21. Social media ads need a notification stating viewers must be at least 21.
